A grade 11 pupil has been released on bail after being arrested for allegedly raping a 13-year-old girl in the boys’ changing room during the morning break on Friday last week, at the Victoria Park High School, according to reports.
The Herald reported this morning that the boy, who has not been identified to protect the girl, who was in a relationship with him before the incident, had appeared in court yesterday, had been released on bail, but would not be allowed back to school.
The Port Elizabeth Magistrate’s Court failed to make an order on whether or not to allow the teenager back on school grounds, but headmaster Michael Vermaak said he would meet with the school’s governing body and regional representatives from the Basic Education Department to discuss a way forward.
Until then, the teenager would not attend class, Vermaak said.
The girl, who is in Grade 8, had informed one of her teachers about the rape after school on Friday. The teacher alerted the principal, who called the girl’s parents and the police.
The boy was arrested after the girl’s parents opened a case against him on Monday and remained in police custody until yesterday.
According to detectives linked to the investigation, the 18-year-old boy, claimed the sex was consensual, which the law defines as statutory rape as he is classified as an adult.
The girl told police she had previously been romantically involved with the teen, but said they had terminated the relationship months ago.
She said she had been talking to a friend outside the boys’ bathroom during morning break last Friday, when the teenager had approached her and asked her friend to leave them alone to talk.
When they were alone, he allegedly forced her into the boys’ bathroom and raped her.
The teenager has denied raping the girl, but even if the sex was consensual he could still be charged with statutory rape as the girl is younger than 16 and legally cannot consent to sex.
His case was postponed to October 30 for further investigation.Vermaak said security would be increased at school during break times.
