The three men behind the robbery at the Metlife Plaza Wimpy in August 2009 have been found guilty in the Eastern Cape High Court (Port Elizabeth), notes a report in The Herald.
Judge Jannie Eksteen convicted Themba Mohale (33), Thabile Matiwane (25) and Bulelani Mabija (25) on four counts of robbery with aggravating circumstances and one count of murder. The robbery made headlines at the time because of the involvement of a Nelson Mandela Bay traffic officer and because of the car chase and shoot-out that ensued involving the robbers, police and a security guard. The report adds the driver of the getaway car in which the three men sped from the scene – Nelson Mandela Bay traffic officer Mhlope Menye – died after sustaining bullet wounds following the car chase. The judge also found Mohale and Mabija guilty of unlawful possession of firearms and ammunition, while Matiwane was acquitted on these charges. All three were also acquitted on a charge of attempted murder after Eksteen found that the state had not proved that they were trying to kill the security guard who had chased after them as they fled the crime scene.
