After the horrific accident over the weekend, which involved the Cradock Primary School, it got me wondering – what is the difference – if you collide with a train on South African roads, which results in deaths, the driver is now arrested and charged with murder. If you are the cause of an accident with another motor vehicle, which results in a death, you may face culpable homicide charges. What is the difference when both acts may have been caused from recklessly ignoring road signs? Perhaps if charges were more serious when breaking laws in the country and law enforcement took their jobs a bit more seriously, we wouldn’t have such a high mortality rate on SA roads.
